The gang that couldn't question straight Nov 8, 2009
As Ryan Lizza recently pointed out in the New Republic, Justice Louis Brandeis declared in 1935 that precedent (OK, he used that pesky two-word Latin phrase) "is not a universal, inexorable command." Getting back to abortion, Chief Justice William Rehnquist quoted Brandeis in his 1992 dissent in the Casey case, the decision that affirmed Roe v. Wade. So when Alito said "inexorable," he was seemingly signaling that he agreed with Rehnquist that Roe should be overturned. (Salon)

The case follows in the wake of the court's landmark 2008 decision in For the first time, the justices found that the Second Amendment protects an individual right to bear arms, rather than "a right to participate in the common defense, as D.C.'s lawyer argued, and it struck down the city's handgun ban. But Heller only affected the federal goverment -- and, by extension, places like the nation's capital. Though the courts have ruled over the years that various parts of the Bill of Rights bind... Another point in the Wednesday letter, a quote from former U.S. Supreme Court Chief Justice William Rehnquist, is the justice's personal, not-very-well-informed, opinion. For Christians, the opinion of the Founding Fathers of this country should be a moot point, since Jefferson and Madison did not invent the principle of separation of church and state - Jesus did. When the court flirted with the question in 1993, a majority ruled against the accused, but Chief Justice William Rehnquist left open the possibility that it may be unconstitutional to execute someone with a "truly persuasive demonstration" of innocence. Oddly enough, for at least some members of the current court that question is now seemingly irrelevant: In Scalia's America, the Cameron Todd Willingham whose very existence was once in doubt is today constitutionally immaterial.
